St. Kitts and Nevis (WINN)—The Four Seasons Resort Estates Homeowners Association in Nevis filed a $100 million lawsuit against Nevis Peak Holdings, LLC, a company owned by Bill Gates’ family office, Cascade Investment, LLC.
According to a People article, the civil complaint was filed on August 11, 2026, in the Delaware Court of Chancery.
The resort operator, Four Seasons Hotels and Resorts (which is also 71.25% owned by Cascade), manages the daily operations but is not named as a defendant in the suit.
The association, which represents 66 property owners holding 89 luxury villas, claims the owner has allowed the five-star property to “deteriorate below any acceptable standard”.
Some of the grievances include:
The golf pro shop and fitness centre remain unbuilt or fenced after being destroyed by an electrical fire in October 2022.
Members claim they paid over $20 million in management and club fees since 2013 for repairs that were never completed.
The HOA said it spent $1.4 million of its own funds over four years to cover emergency electrical and infrastructure repairs.
The suit cites outdated or failing water systems, trash accumulation, broken golf carts, missing pool tiles, rotted wood, and peeling paint.
An independent 2021 assessment cited in the complaint found that the tennis, spa, and golf amenities did not meet world-class standards and that $6.5 million to $8.5 million in immediate golf course remediation was required.

Premier Hon Mark Brantley surmised that the lawsuit should not affect hotel operations and the employees.
“Cascade, which is the ownership group, and Nevis Peak Holdings, I gather, have been sued in a court in Delaware by the Homeowners Association here, and there are certain allegations about the upkeep of the property. I do not at this point see that having any effect on the hotel itself or the workers. I suspect that it is the homeowners’ way of forcing the hotel to do some necessary upgrades and necessary upkeep. For example, I know one of the main points of contention is that since the gym burnt down, which was, I believe, in 2023, it has not been rebuilt. And remember that the homeowners are claiming that they’re paying fees and homeowners’ dues, etc., and so they’re paying all this with the expectation that the hotel will be maintained at a particular standard. And I’ve seen the plans for the new gym and new spa. They are absolutely fantastic, but also quite expensive in terms of the investment. I believe it’s over $20 million. So Cascade has not yet spent that money, and the homeowners are arguing that it’s taking too long. You need to spend the money. You need to bring the property up to scale.”
Brantley said the situation is being monitored and that he has engaged with the involved parties.
“So this is the current state of play. The government has no role to play in that except to monitor, and of course, if something were to develop that is impacting the island in a negative way, then we would definitely get involved. At this stage, we have not yet formed a view whether we should intervene in any way in the proceedings in Delaware, whether as a watching brief or otherwise. So certainly we are in conversation with both sides at this point, with the homeowners and with Cascade, just to monitor where things are and what’s happening. But we will be alert to protecting the interests of the people of Nevis. At this juncture, we see no threat to the workers of the Four Seasons at this point. I should say that the Four Seasons did put out a notice; I’m not sure if it has happened yet, that they will be closed for one week, and that has to do with some significant maintenance that they have to do at the resort. So that notice already went out. As I said, I’m not sure if the closure has already happened.”
He continued, “If it has not, then it should happen very shortly. But that has gone out to workers, et cetera, and to the government, that that one-week closure has to do with some critical maintenance work that has to be undertaken at the hotel. So that’s separate and apart, and has nothing to do with the lawsuit. But the lawsuit is real. Filings have occurred, and I’ve had conversations with the general manager, with Cascade. They’re based in Seattle. They’re the ownership group. They’re the group that represents Mr Bill Gates. And I’ve had conversations with the homeowners as well in relation to this matter. So we are actively monitoring, although we do not think at this point there is any need for a decision to intervene in any way, shape, or form. We have to just accept that people have disputes, and when they have disputes, they go to court. That’s what it’s about. My interest is to ensure that the workers are not disadvantaged in any way. And we are alert to that, and definitely will be paying close attention to this.”
Brantley made those comments during his recent press conference.
A spokesperson for Cascade Investment said they intend to fight the allegations by the Four Seasons Resort Estates Homeowners Association “which it believes are entirely without merit.”
